1. Acceptance of Terms

By creating an account, accessing, or using FlexiPro App (the “FlexiPro”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you should not use the App.

2. Description of Services

FlexiPro provides an online platform offering self-guided strength and flexibility training programs (“Services”). The Services include:

Access to pre-designed workout programs and routines
Exercise demonstrations via video, images, and written instructions
Progress tracking tools
Customizable training schedules
Educational content related to fitness, strength training, and flexibility

You acknowledge that:

All programs are designed for self-guided use without real-time supervision
You are solely responsible for executing exercises safely and correctly
FlexiPro standard membership does not provide personalized coaching
FlexiPro does not provide medical advice, or real-time instruction

3. Restrictions and Requirements

3.1 Eligibility

You must be at least 18 years of age to use FlexiPro unsupervised
If you are between 13-17 years old, you may only use the App with parental consent and supervision
Users under 13 are not permitted to use the App without prior consultation with the FlexiPro coaching team.

3.2 Health and Safety Requirements

Before using the Services, you must:

Consult with a qualified healthcare provider to ensure you are physically capable of participating in strength and flexibility training
Disclose any medical conditions, injuries, or physical limitations that may affect your ability to exercise safely
Obtain medical clearance if you have any pre-existing conditions, including but not limited to cardiovascular disease, joint problems, or mobility limitations

3.3 User Responsibilities

You agree to:

Use proper form and technique when performing exercises
Start with appropriate difficulty levels for your fitness level
Listen to your body and stop exercising if you experience pain, dizziness, or discomfort
Ensure you have adequate space and appropriate equipment for exercises
Not hold FlexiPro liable for any injuries sustained while using the programs

3.4 Prohibited Uses

You may not:

Share your account credentials with others
Reproduce, distribute, or commercially exploit any content from FlexiPro
Use FlexiPro for any unlawful purpose
Reverse engineer, decompile, or attempt to extract source code from FlexiPro
Upload viruses or malicious code
Impersonate others or provide false information

4. Medical Disclaimer

THE SERVICES ARE NOT MEDICAL ADVICE. The content provided through FlexiPro is for informational and educational purposes only. FlexiPro does not provide medical advice, diagnosis, or treatment.

You understand and agree that:

You assume all risks associated with participating in physical exercise
FlexiPro is not responsible for any injuries, health complications, or adverse effects resulting from your use of the programs
You should stop exercising immediately and consult a healthcare provider if you experience any adverse symptoms

5. Subscription Terms and Pricing

5.1 Subscription Plans

FlexiPro offers the following subscription options:

Standard Monthly Plan: US$65.00 per month
Personalised Training Plan: US$149.00 per month

Users that upgrade from a standard monthly plan to a personalized training plan will pay the difference between the prices, not the sum. This will result in 2 separate monthly subscriptions for the total amount i.e. US$65 + US$84 billing monthly on the date of the respective initial purchase.

All prices are in US$ and are subject to applicable taxes.

5.2 Billing Cycle

Subscription fees are charged in advance on a recurring basis according to your selected plan
Monthly subscriptions are billed the same date every month until the subscription is cancelled.

Your subscription start date is the date you complete your initial purchase.

5.3 Payment Method

You must provide a valid payment method (credit card, debit card, or other accepted payment method)
You authorize FlexiPro to charge your payment method for all fees incurred
You are responsible for maintaining valid payment information and updating it as necessary

5.4 Price Changes

FlexiPro reserves the right to modify subscription prices at any time
Price changes will be communicated to you via email at least 30 days before taking effect
Price changes will apply to your subscription upon your next renewal date after the notice period
If you do not agree to a price increase, you may cancel your subscription before the new price takes effect (see Section 6)

6. Automatic Renewal and Cancellation

6.1 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

You will be charged the then-current subscription fee for your plan
Renewal occurs automatically without additional action or confirmation from you
You will receive an email confirmation and receipt for each subscription renewal.

6.2 How to Cancel Your Subscription

To prevent automatic renewal and stop future charges, you must cancel your subscription before your renewal date.

You can cancel your subscription through either of the following methods:

Method 1: Online Account Portal

Visit flexibilitymaestro.trainerize.com
Log into your account
Go to “My Account” > “Purchases”
Click “Cancel Auto-renew” and confirm

If you cannot cancel and want to prevent future charges, remove your credit card information from your account on the desktop site.

Method 2: Email Request

Send an email to [email protected] with the subject line “Subscription Cancellation”
Include your full name and the email address associated with your account
Cancellation will be processed within 5 business days

6.3 Cancellation Timing and Effect

Cancellations must be submitted online at least 24 hours before your renewal date to prevent the next charge
Cancellations must be submitted via email request at least 5 business days before your renewal date
If you cancel after being charged for a renewal period, the cancellation will take effect at the end of that billing period
You will retain access to FlexiPro until the end of your current paid period
Cancellations submitted less than 24 hours before renewal may still result in a charge for the next billing period

6.4 No Partial Refunds

Cancellation does not entitle you to a refund for the current billing period
You will not be charged for any subsequent billing periods after cancellation takes effect
No refunds or credits will be issued for partial months

6.5 Confirmation

You will receive a confirmation email once your cancellation is processed
If you do not receive confirmation within 2 business days, contact [email protected] to verify cancellation status

7. Free Trials and Promotional Offers

7.1 Free Trial Terms

FlexiPro may offer free trial periods for new users
Free trials are available once per user and require a valid payment method
Your payment method will be automatically charged at the end of the trial period unless you cancel before the trial ends
To avoid charges, you must cancel at least 24 hours before the trial period expires
Trial duration and terms will be clearly disclosed at sign-up

7.2 Promotional Offers

Promotional pricing or discounts may be offered periodically
Promotional offers are subject to specific terms and eligibility requirements
After a promotional period ends, you will be charged the standard subscription rate unless you cancel
If you are already on a subscription plan you are not eligible for sign-up promotional offers however there may be additional promotional add-on offers for which you are eligible.

8. Refund Policy

8.1 No Refunds

All subscription fees are non-refundable except as required by law
This includes situations where you:
- Do not use the App during a paid period
- Cancel mid-billing cycle
- Are dissatisfied with the Services
- Experience technical difficulties on your device

8.2 Exceptions

Refunds may be issued at the sole discretion of FlexiPro in the following circumstances:

Technical errors resulting in duplicate charges
Charges made after cancellation was properly submitted
Charges made after account deletion was requested

To request a refund for an exceptional circumstance, contact [email protected] within 14 days of the charge.

9. Account Termination

9.1 Termination by You

You may delete your account at any time through FlexiPro settings
Account deletion does not automatically cancel your subscription
You must separately cancel your subscription to stop future charges (see Section 6.2)

9.2 Termination by FlexiPro

We reserve the right to suspend or terminate your account if you:

Violate these Terms of Service
Engage in fraudulent or illegal activity
Fail to pay required fees
Misuse the Services in a manner that harms other users or FlexiPro
Communicate in the group chat in such a manner that is considered offensive, abusive or discriminatory to other members or generally

9.3 Effect of Termination

Upon termination, your right to access and use FlexiPro immediately ceases
You will not be entitled to any refund of fees paid
FlexiPro may delete your account data in accordance with our Privacy Policy

10. Intellectual Property

10.1 Ownership

All content, features, and functionality of FlexiPro, including but not limited to:

Workout programs and routines
Exercise videos, images, and demonstrations
Written content and instructions
Software, code, and algorithms
Trademarks, logos, and branding

are owned by FlexiPro or its licensors and are protected by copyright, trademark, and other intellectual property laws.

10.2 Limited License

Subject to these Terms, FlexiPro grants you a limited, non-exclusive, non-transferable, revocable license to access and use the App solely for your personal, non-commercial use.

10.3 Restrictions

You may not:

Copy, modify, or create derivative works from FlexiPro content
Distribute, sell, or transfer content to third parties
Remove copyright notices or proprietary markings
Use content for commercial purposes

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

FlexiPro and the operating company Flexibility Maestro Limited shall not be liable for any injuries, damages, or health complications arising from your use of the services
You assume all risk of injury when participating in strength and flexibility training
FlexiPro and the operating company Flexibility Maestro Limited make no warranties regarding the effectiveness, safety, or suitability of any programs for your individual needs
In no event shall FlexiPro or the operating company Flexibility Maestro Limited be liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability shall not exceed the amount you paid for the services in the 12 months preceding the claim

12. Indemnification

You agree to indemnify, defend, and hold harmless FlexiPro or the operating company Flexibility Maestro Limited and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use or misuse of the Services
Your violation of these Terms
Your violation of any rights of third parties
Any injuries or damages resulting from your participation in training programs

13. Data and Privacy

Your use of FlexiPro is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using FlexiPro, you consent to the collection, use, and sharing of your information as described in the Privacy Policy, available at flexibilitymaestro.com/privacy-policy

14. Changes to Terms

FlexiPro reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to FlexiPro or website. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Your continued use of FlexiPro after changes are posted constitutes acceptance of the modified Terms.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by the laws of Ontario, Canada, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

Informal Negotiation: Contact [email protected] to attempt resolution
Binding Arbitration: If negotiation fails, disputes shall be resolved through binding arbitration in accordance with Arbitration Act, 1991, S.O. Canada
Small Claims Court: You may assert claims in small claims court if they qualify

15.3 Class Action Waiver

You agree to resolve disputes with FlexiPro on an individual basis only. You waive any right to participate in class actions or class arbitrations.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FlexiPro regarding the Services and supersede all prior agreements and understandings.
